Next Steps:
  1. Once you submit your application online you will receive an email within 24-48 hours that your application has been received. The email may request additional information that will need to be emailed.  Such as a picture of your booth setup and product.
  2. Once your application is approved you will receive an email requesting payment for your booth with your booth location.
  3. Once payment is confirmed, you will receive additional information about the event for load in/load out and all information you need to know to have a successful event.

The following General Information sheet contains pertinent rules and procedures concerning the Exhibitor Agreement.  By submitting this online application you are acknowledging that you are reading, understanding and accepting the rules and terms of the General Information.

Taxes/Insurance
  • You must have a California State Board of Equalization Seller’s Permit or we cannot accept your application. If you are exempt from tax, you may input zeros.  Exhibitors are responsible for collecting and reporting sales tax.
  • Craft and food vendors are responsible for their own liability and workers compensation insurance. By submitting an online application you agree to release the Encinitas Chamber of Commerce (“Chamber”), the City of Encinitas (“City”), and 101 Event Agency from any and all liability.
Product limitations
  • No stolen merchandise, firearms, knives, ammunition, explosives, alcoholic beverages, drugs or illegal items, tobacco, tobacco/drug paraphernalia, or items that promote the use of any Federally controlled substance, including Marijuana.
  • The following are prohibited per Encinitas Municipal Code:
    • • Single-Use Plastic Bags (EMC 11.26)
      • Expanded Polystyrene (Styrofoam) containers (EMC 11.27)
      • Expanded Polystyrene (Styrofoam) packing materials (foam peanuts, foam popcorn, foam packing noodles) (EMC 11.27)
      • Plastic Utensils (EMC 11.27)
      • Plastic Beverage Straws (EMC 11.27)
      • Single-Use plastic bottled beverages one liter or less (EMC 11.29)
    Cancellations/Refunds
    • ABSOLUTELY NO REFUNDS within 30 days of the event.
    • Any refunds processed will incur a $50 processing fee.
    • No refunds will be given in case of incident weather, acts of nature, or restrictions by government agencies, over which the Encinitas Chamber of Commerce has no control.
    Assumption of Risk

    Event Release of Liability Waiver – BY SUBMITTING THIS BOOTH ORDER I AM ACKNOWLEDGING AND AGREEING TO ALL THE ABOVE EVENT TERMS AND THE BELOW WAIVER OF LIABILITY – With my submission, I agree to waive, release, indemnify, and hold harmless the Encinitas Chamber of Commerce (“Chamber”), the City of Encinitas (“City”), and 101 Event Agency from any and all liability, claims, and causes of action, including attorney’s fees and court costs, for injuries or damages to person or property arising out of my participation in the Encinitas Oktoberfest event except injury or damages deliberately or willfully caused. In addition, I acknowledge the contagious nature of COVID-19 (and all variants) and voluntarily assume the risk that I and any business partners may be exposed to or infected by COVID-19(or a variant thereof) by attending a Festival and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I and my business partners voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to ourselves (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that we may experience or incur in connection with our attendance at the Festival. On my behalf, and on behalf of my business partners (or booth staff), I hereby release, covenant not to sue, discharge, and hold harmless the City, the Chamber, their employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind.


    I HAVE CAREFULLY READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AND BY SUBMITTING THIS ORDER I AM ACKNOWLEDGING AND AGREEING TO ALL EVENT TERMS AND WAIVER OF LIABILITY. BY SUBMITTING THIS ONLINE APPLICATION I AGREE TO ALL TERMS AND CONDITIONS FOR THIS EVENT.
